By accessing and using WhiteContext's web intelligence API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Service Description

WhiteContext provides a web intelligence API that analyzes company websites to extract structured business intelligence data. The Service is designed for B2B sales, marketing, and business development purposes.

3. Pricing and Billing

3.1 Pricing Model

  • Base rate: $1.00 USD per company record analyzed
  • Billing is pay-per-use based on successful API requests
  • Volume discounts available for high-volume users (contact sales)
  • Prices subject to change with 30 days notice

3.2 Payment Processing

  • All payments are processed securely through Stripe
  • Payment methods accepted: major credit cards and ACH transfers
  • Invoices are generated monthly for pay-per-use customers
  • Payment is due within 30 days of invoice date

3.3 Refund Policy

Refunds may be issued for technical errors on our part that result in failed data delivery. No refunds for successfully delivered data, changes in business needs, or user errors.

4. API Usage and Limits

  • Rate limit: 60 requests per minute per API key
  • Bulk requests: Maximum 100 URLs per batch request
  • Fair use policy applies to prevent abuse
  • Automated testing against our API is prohibited

5. Account Terms

You are responsible for:

  • Maintaining the security of your API keys
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your use complies with all applicable laws

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harvest personal data for spam or harassment
  • Perform competitive intelligence against WhiteContext
  • Reverse engineer or attempt to extract our source code
  • Resell or redistribute data without authorization
  • Overload our servers with excessive requests

7. Data and Privacy

  • We process only publicly available website data
  • You retain ownership of your submitted URLs
  • We do not sell or share your data with competitors
  • Our data practices are detailed in our Privacy Policy

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by WhiteContext and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to use the Service per these Terms.

9. Service Level Agreement

  • 99.9% API uptime target (excluding scheduled maintenance)
  • Processing time: Most requests complete within 30-60 seconds
  • Support response time: 24-48 hours for standard inquiries
  • No guarantee of specific data availability for any given website

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee the accuracy, completeness, or timeliness of extracted data. Data quality depends on the source website's structure and content availability.

Our liability is limited to the amount you paid for the Service in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify and hold WhiteContext harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

  • Either party may terminate with 30 days written notice
  • We may suspend or terminate immediately for Terms violations
  • Upon termination, API access will be revoked
  • Pending charges must be paid in full

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email with 30 days notice. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Delaware.
